Terms and Conditions

This document contains the terms and conditions which, together with the Sportegg Privacy Policy (“Privacy Policy”), users agree to by browsing or accessing the Sportegg website at http://www.sportegg.com (referred to in this document as “Sportegg”, “we” or “us”).

The Privacy Policy contains important information about how we can collect and use personal and anonymous data on you, the user, and we encourage you to read and understand it.

User Conduct and Sportegg

All information and communications posted to Sportegg, whether in the form of text, data, sound, pictures, videos or other material (“content”), are the sole responsibility of the user from whom the content comes. You, and not Sportegg, are responsible for all content you upload and the consequences of your conduct. Except as and when specifically required by the law, we do not control the content posted by our users and do not guarantee the accuracy, integrity or legality of anything posted by our users.

Sportegg is intended to be a site where like-minded people can share their sporting interests with each other and share content relating to those interests. Our content is generated by our users, and for that reason, we accept no liability for any content posted by our users, whether as a result of errors or omissions, losses or damage arising from content. Because we cannot guarantee that people will always behave well or properly, you agree that by viewing Sportegg, you may be exposed on occasion to content which you consider offensive, indecent or otherwise objectionable.

While we don’t screen content, we retain the right to use our discretion to modify or remove content on any part of Sportegg. To minimise offense to others, we require our users to agree not to:

  1. Post content that is unlawful or defames others;
  2. Post content which is inappropriate for children;
  3. Impersonate others or misrepresent your affiliation with a person or entity;
  4. Harassing others;
  5. Post content which violates others’ intellectual property rights or which you are not entitled to post by virtue of a general law or legal obligation;
  6. Post sensitive personal information or copies of identification documents;
  7. Post advertising (unless in a location where explicitly permitted by Sportegg), solicitations or “spam”; or
  8. Upload viruses, trojans, spyware or other malware designed to interrupt, damage, limit or wrongfully exploit software, hardware or telecommunication systems – (including the use of automated or manual systems for harvesting the personal data of other users).

If you are a registered Sportegg user, we consider that you retain all your rights with respect to the content you post on Sportegg. However, to allow us to operate the site, your consent to the following is required:

  1. You grant Sportegg and its operator(s) or any sub-licensee, a non-exclusive, transferable, royalty free worldwide licence of any and all intellectual property rights subsisting in the content you post. The licence you grant us terminates when you delete removable content from Sportegg or close your user account, with the following limited exception. Should you believe that your intellectual property rights are being violated by any content on Sportegg or by any action Sportegg takes, please inform us at info@sportegg.com.
  2. The licence granted above will continue to apply for so long as backup copies are retained on our servers in the normal course of operating Sportegg, and for so long as any of your content which has been re-posted or shared by other registered users is in use under the terms of their agreement with us.
  3. You agree that Sportegg will in no circumstances be under an obligation to pay or compensate you for posting content, or for any other contribution to Sportegg.
  4. In order to protect Sportegg, the integrity of our services and the security of our users, you acknowledge that you have no right under the Terms and Conditions to use or assert ownership or any interest in Sportegg’s name, logos or our other intellectual property, or the intellectual property of others which you may obtain or come across via Sportegg
  5. We don’t guarantee that the site will always be available.
  6. You also agree to indemnify and hold Sportegg and its subsidiaries, affiliates, employees, officers, agents or partners harmless from any direct or indirect loss or damage of any kind arising from content you post to Sportegg, your use of the site or your breach of the Terms and Conditions.

Your Account as a Registered User

In order to ensure that user accounts are used in a productive way that benefits Sportegg and the community of Sportegg users, we require you to agree to the following:

  1. You won’t use Sportegg if it’s illegal to do so where you are located.
  2. You will not share passwords or accounts with others, or allow your password to fall into others’ hands.
  3. You will not transfer your Sportegg account to another person.

Amendments to the Terms and Conditions

Sportegg may amend the Terms and Conditions (and the Privacy Policy) from time to time, and is not required to give every user advance notice when it does so. The Terms and Conditions applicable to all users will always be the current version, which will be posted here.

Closing Your Account

Sportegg’s service to its registered users is provided free of charge, and we may accordingly stop providing our services to you at any time without being required to provide notice to you. If we do so, any provisions of the Terms and Conditions or the Privacy Statement which need to survive in order to give effect to the intent behind them will continue to apply.

Should you wish to close your account, you may do so by contacting us at support@sportegg.com with details of your request.

Resolving Disputes and Problems with Sportegg

Although we do our best to provide a safe, useful environment for our community of users, you acknowledge that use of Sportegg is at your own risk and offered on an “as is” basis, and that Sportegg’s operators offer you no statutory or other warranties relating to the quality of our service or the security of content or other information provided to Sportegg.

Sportegg , its owners, employees, agents and management will not be responsible for the actions of other users and third parties and you agree to release Sportegg and its owners, employees, agents and management from any claims of any kind, whether known or unknown, arising either in connection with the services or in connection with the claims of other users and third parties.

You agree that this is to be a comprehensive limitation of liability applying to all damages of any kind, including compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss or damage to property or third party claims. Sportegg is a site for people interested in sports and physical activities, and you therefore agree and acknowledge that by participating in such activities you are assuming the normal risks associated with activities of that type, and that you will not attempt to hold Sportegg liable for those risks.

Notwithstanding, none of these exclusions or limitations are intended to limit your consumer or other statutory rights under local law to the extent these may not be, by law, excluded, including liability to you for death or personal injury resulting from Sportegg’s negligence or that of our employees or agents, or claims for fraud or wilful misconduct on the part of Sportegg or its employees.

You agree that the laws of England and Wales only will apply to any dispute between us and that in the event you intend to bring any legal action against us, you will do so in the courts of England and Wales.

General Provisions

You agree that the current Terms and Conditions comprise the entire agreement between us relating to Sportegg and its services, and that they supersede any prior agreements. If any part of the Terms and Conditions should be rendered unenforceable, you agree that the remaining terms will continue in force

Any failure by Sportegg to enforce the Terms and Conditions or exercise a right under them will not be considered a waiver. We will only amend or waive our rights in a writing executed by someone duly authorised by Sportegg. We can also assign our rights under the Terms and Conditions, for example if ownership or control of Sportegg passes to another party.

Neither of us intends by the Terms and Conditions to confer any rights on third parties under the Contracts (Rights of Third Parties) Act 1999.
